TERMS AND CONDITIONS FOR USE OF THE VEINTERATMENT.EU WEBSITE

This document contains the Terms and Conditions of the Contract for use of the free information services provided by VARIX CLINIC EOOD through the VEINTREATMENT.EU Website (the “Terms and Conditions”) and regulates the contractual relations between MC VARIX CLINIC EOOD and the right of each of the users to use free of charge for personal and non-commercial purposes the free information services available through the Internet Site www.veintreatment.eu, subject to the conditions below.

By accessing (loading) the Internet page, you agree to be bound by these Terms and Conditions and any subsequent changes thereto, and you also agree to follow them. In the event that you do not agree to all the Terms and Conditions below, please do not use the VEINTERATMENT.EU Website.

I. DEFINITIONS 

In the interpretation and application of these Terms and Conditions, the terms and expressions used shall have the following meaning: 

1.1. “IP address” is a unique identification number, associating a device, an Internet page or a resource of the user, in a way that allows their localization in the global Internet network;

1.2. MEDICAL CENTER VARIX CLINIC EOOD (hereinafter referred to as MC VARIX CLINIC) is a medical institution for outpatient care, registered in the Commercial Register and the Register of Non-Profit Legal Entities at the Registry Agency with UIC 204273500, with seat and management address in the city of Sofia, 1614, Ovcha Kupel area, Gorna Banya quarter, 7, Orehovski Dol Str., tel. +359 882352352, е-mail: info@veintreatment.eu, which provides the services subject to these Terms and Conditions, through the portal administered by it: https://VEINTERATMENT.EU

1.3. VEINTERATMENT.EU /The VEINTERATMENT.EU website (http://VEINTERATMENT.EU) is a website (portal) – a virtual information resource through which USERS are provided with information services described in these Terms and Conditions;

1.4. “Hyperlink” is a link designated in a particular Internet page that allows automated referral to another Internet page, information resource or object through standardized protocols;

1.5. “Internet page” is a part of a website, which may be composite or separate;

1.6. “Information System” means a device or a system of connected devices, which or any of which is intended to store, send or receive electronic documents;

1.7. “USER” is any person who uses any of the information services provided through the VEINTERATMENT.EU Website.

1.8. “Server” is a device or a system of connected devices, on which or on any of which system software is installed to perform tasks related to the storage, processing, reception or transmission of information. 

1.9. “Website” is the designated place in the global Internet network accessible through its unified address (URL) under the HTTP or HTTPS protocol and containing files, programs, text, sound, picture, image, electronic references or other materials and resources.

1.10. “Unforeseeable circumstance” is an unforeseen circumstance of an extraordinary nature at the time of the conclusion of the Contract, which makes its implementation objectively impossible.

ІI. SUBJECT OF THE CONTRACT

2.1. MC VARIX CLINIC through the VEINTERATMENT.EU Website provides on-line to the USER the services provided in these Terms and Conditions (the “Services”), subject to strict compliance by the latter with the requirements set out in these Terms and Conditions.

2.2. The main features of the services provided to the USER via the Internet Site, hereinafter referred to as the “Services”, are the following:

(1) the opportunity to view and share the content posted on the Internet Site. VEINTERATMENT.EU provides information about itself, its team, the services it provides, current offers, information articles, contacts and others;

(2) the possibility of generating a telephone call through functional buttons on the Internet Site;

(3) the possibility of generating electronic inquiries by e-mail address (e-mail) through a functional inquiry form within the Internet Site, the so-called “Feedback Form”. The USER should fill in the specified fields and select the Send button. When using this service, USERS should also keep in mind that by accepting these Terms and Conditions, they should be considered informed that the use of this service does not automatically lead to the conclusion of a Contract between the respective user and MC VARIX CLINIC, i.e. sending an inquiry by email does not create an obligation for MC VARIX CLINIC to provide a certain service and does not put MC VARIX CLINIC and the user in a contractual (obligatory) relationships. It should be considered that the relevant user who has sent an email request to MC VARIX CLINIC has concluded a Contract with MC VARIX CLINIC for the performance of the given service only after receiving a confirmation in this regard from MC VARIX CLINIC. MC VARIX CLINIC does not guarantee its ability to respond and the period within which such will be provided.

(4) the possibility of generating electronic inquiries by means of an e-mail used by the user, by means of a functional reference from the Internet Site. For this purpose, the user needs to select a specific functional reference on the Internet Site (a place where an email address of MC VARIX CLINIC is written and can be “clicked” on) and the device used by him/her to open a new window for writing a message from an email client set on the device;

(5) The superdoc.bg platform is not part of the VEINTERATMENT.EU Website and MC VARIX CLINIC is not responsible for the correctness and reliability of the information and services available through the superdoc.bg platform.

ІІІ. FIELD OF APPLICATION. AGREEMENT TO THE TERMS AND CONDITIONS

3.1. These Terms and Conditions shall apply in the relations with the USERS of the VEINTERATMENT.EU Website.

3.2. The text of these Terms and Conditions is available on the Internet at the Internet page http://veinteratemnt.eu in a way that allows its storage and reproduction. An electronic link to the Internet page containing the text of these Terms and Conditions is located on each page of the VEINTERATMENT.EU Website. By each use of the information services and resources of the VEINTERATMENT.EU Website, including by opening an Internet page from the VEINTERATMENT.EU Website, as well as by clicking on an electronic link from the home page or any other Internet page of the VEINTERATMENT.EU Website, USERS declare that they are familiar with these Terms and Conditions, agree with them and undertake to comply with them.

IV. CONCLUDING THE CONTRACT 

4.1. The Contract between the parties shall take effect from the moment of reaching an agreement, objectified in the manner specified in item 3.2.

4.2. The Contract shall be concluded in English. 

4.3. The Agreement shall be effective until the termination of the use of the Services under item 2.2.

4.4. Upon conclusion of the Contract between the User and MC VARIX CLINIC, the user makes an explicit electronic statement within the meaning of the Law on Electronic Documents and Electronic Certification Services (LEDECS), declaring that he/she is familiar with the Terms and Conditions of the site, accepts them, agrees with them and undertakes to comply with them, as well as that he/she is familiar with the Data Privacy Policy (declaration) of MC VARIX CLINIC.

V. CHANGES TO THE TERMS AND CONDITIONS

5. The Terms and Conditions may be changed unilaterally by MC VARIX CLINIC. When making changes to the Terms and Conditions, MC VARIX CLINIC brings them to the attention of the USERS by publishing them on the VEINTERATMENT.EU Website. Changes to the Terms and Conditions shall enter into force for USERS without the need to explicitly notify the latter.

VI. INTELLECTUAL PROPERTY

6.1. All information published on the Internet Site, including but not limited to: texts, photos, audio and video materials, is the intellectual property of MC VARIX CLINIC or is used by the latter on a legal basis and as such is protected by the current legislation on the protection of intellectual property, including but not limited to the protection of copyright and related rights.

6.2. MC VARIX CLINIC reserves all the rights referred to in the previous paragraph.

6.3. The use of the information referred to in paragraph 1 of this Article, including but not limited to: copying, modification, reproduction, without the consent and permission of MC VARIX CLINIC or the respective holder of intellectual property rights, except in the cases expressly specified in the law, is prohibited and constitutes a violation of the rights of MC VARIX CLINIC on intellectual property or those of their respective carrier, in case it is different from MC VARIX CLINIC.

6.4. The Internet Site may contain names and brands of products, services or persons that represent or may represent trademarks owned by MC VARIX CLINIC or third parties. Access to the Internet Site, as well as nothing in these Terms and Conditions or the rest of the content of the Internet Site shall be understood and/or interpreted as and does not constitute the granting of a license or a right to use any such trademark, without the prior written consent of MC VARIX CLINIC or the relevant third party – owner of the intellectual property object in question.

VII. RESPONSIBILITY. LIMITATION OF LIABILITY 

7.1. The information and materials available on the Internet Site (including but not limited to: articles, images, messages, etc.) are of an informative, general and abstract nature and do not represent, nor should they be accepted or interpreted as advice, guidance and/ or consultation provided by MC VARIX CLINIC to any of the users of the Internet Site.

7.2. MC VARIX CLINIC is not responsible for the correctness, reliability, truthfulness and/or up-to-dateness of the information and materials available on and/or through the Internet Site, for any reason, nor for their applicability to a specific factual situation.

7.3. MC VARIX CLINIC shall not be liable for the content of the Internet Site, nor shall it be liable for damages suffered by any user and/or third party in connection with the use of the Internet Site and/or the information and materials available on it, including their application to a specific situation (for example: taking specific actions by a user based on information posted on the Internet Site).

7.4. MC VARIX CLINIC is not responsible for failure to provide the services in the event of circumstances beyond its control – in cases of force majeure, accidental events, problems in the global Internet network and in the provision of services beyond the control of MC VARIX CLINIC, problems due to the USER’S equipment, as well as in the event of unauthorized access or intervention by third parties in the operation of the information system or servers of MC VARIX CLINIC.

7.5. MC VARIX CLINIC shall not be liable for damages caused to the software, hardware or facilities of the USER, or for loss of data resulting from materials or resources searched, loaded or used in any way through the Services provided.

7.6. By accepting these Terms and Conditions, the USER declares that he/she is aware of the possibility of possible interruptions and other difficulties in the implementation of the Internet connection to the VEINTERATMENT.EU Website, which may occur regardless of the care provided by the MC VARIX CLINIC. The USER declares that he/she will not claim any compensation from MC VARIX CLINIC for lost profits, damages or inconveniences due to the occurrence of the above interruptions or difficulties of the Internet connection, including in terms of the capacity of this connection.

ХІІI. PERSONAL DATA PROTECTION

8. MC VARIX CLINIC takes due care of the collection, processing and storage of USERS’ personal data, in strict compliance with the provisions of the Personal Data Protection Act, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), our Data Privacy Policy (declaration) and related Bulgarian and European legislation. 

ІХ. TERMINATION AND DISSOLUTION OF THE AGREEMENT

9. Except in the cases provided in these Terms and Conditions, the Contract between the parties shall be terminated upon the occurrence of any of the following circumstances:

a/ termination of the activity of MC VARIX CLINIC or termination of the maintenance of the VEINTERATMENT.EU Website; 

b/ mutual consent of the Parties for the termination; 

c/ in the event of the objective inability of either of the parties to the Contract to fulfil their obligations;

d/ in the event of the confiscation or sealing of equipment by the state authorities;

e/ other cases specified by the law. 

Х. OTHER CONDITIONS

10.1. The Parties agree that in the event that any of the clauses of these Terms and Conditions turns out to be invalid, this will not entail the invalidity of the Contract, other clauses or parts thereof. The invalid clause will be replaced by the imperative rules of law or the established practice.

10.2. The VEINTERATMENT.EU Website is maintained by MC VARIX CLINIC through technical equipment located on the territory of the Republic of Bulgaria. MC VARIX CLINIC does not guarantee and is not responsible for the accessibility and proper provision of the Services on the VEINTERATMENT.EU Website outside the territory of the Republic of Bulgaria. In the event that the USER uses the Services subject to these Terms and Conditions outside the territory of the Republic of Bulgaria, the USER is solely responsible for compliance with the applicable legislation in accordance with the place of use of the Services.

10.3. The provisions of the effective legislation of the Republic of Bulgaria shall apply to all issues not covered by this Contract.

10.4. All disputes between the parties shall be resolved in the spirit of understanding and good faith. In the event that no agreement is reached, all unresolved disputes arising out of or relating to the Contract between the parties, including disputes arising out of or relating to its interpretation, invalidity, performance or termination, and disputes to fill in gaps in the Contract or its adaptation to new circumstances, will be resolved by the competent court in the city of Sofia under the current Bulgarian legislation.
